There is a (historical) reason behind this madness.

We here at the City of Saint Paul designed into earlier versions of GeoMoose the idea of grabbing the Map, Legend and for some layers, a IMAGEMAP for every layer upon the layer being turned on.  This was done at the time for a better user experience, since those extra calls are essentially all done up at once and upon layer loading. And they were ready for use when needed.  The thought was that the overhead of doing these calls up front was negligible (and I believe it still is) related to the overall performance of the GeoMoose interface.  I don't know which of these capabilities have been turned off or on between GeoMoose versions, but we still have this method in place on our production services and nobody has complained yet.

I can see that there is a tidiness factor here that some would spot, but I lean towards less code, and adding in more validation steps goes in the other direction in my mind.

Either way I would do as Dan suggested and file a bug.

I noticed that GeoMOOSE 2.6.1 requests MapServer to create legend images even if the legend is collapsed in the Catalog.  This creates a lot of unnecessary requests, especially if a user never expands the legend for a layer.  In my opinion GeoMOOSE should not request a legend image from MapServer if the legend for a layer is collapsed.
