I don't think that it is related.
I think that it is a GDAL issue. You may check and join my bug report
http://trac.osgeo.org/gdal/ticket/1239

Since the hack mostly works, I don't bother any more :-)
In most cases I am also using the MODIS Reprojection Tool.
