No, the EMPTY statement does not work with GetFeatureInfo. There was 
already a ticket about this:
   http://trac.osgeo.org/mapserver/ticket/546

I have implemented a fix for this and committed to SVN trunk a few 
minutes ago. You'll find all the details in the ticket.
