Asnswering my own ques, but thats ok in case somone alse asks.

after hunting for some time and trying many different things I found it.
In OpenLayers.js around line 320
LayerSwitcher=OpenLayers.Class(OpenLayers.Control,{activeColor:"darkblue"
changed darkblue to transparent.
