I think the ticket explains? Specifically, it's a rounding error issue.
intersectsBounds does a check to see if two bounding boxes overlap, and
they do, even when they shouldn't.

A workaround might be to try putting your bbox and maxResolution into
integers. I think that would avoid th floating point issues. (If you
can't figure out how, you can share your maxExtent and maxResolution
with the list and someone might try to help.)
