This hack definitely violates the Terms of Use.<br><br>The reason for the reappearing popup is tht th 3.6 version of the GMaps API is no longer available, so you get 3.7 now even if you request 3.6.<br><br>Until somebody provides a fix in OpenLayers, my advice is to use a different base map.<br>
