<p>Today I got initial feedback from the Zurich tax authorities.
They did a first initial check - and the good news is, that it
still seems feasible that we get tax exemption. But they ask for
additional material/documents:</p>
<ul>
<li>"Tätigkeitskonzept" (a document explaining what <a href="http://QGIS.ORG" target="_blank">QGIS.ORG</a> is
doing, what our purpose is, why we are non-profit, etc.) -
apparently, the description in the charter is not good enough</li>
<li>they ask if we have any SLAs with public authorities. I think
we can say no, because this is the domain of the companies doing
support</li>
<li>our budget for 2018 (which I have to do anyway)</li>
</ul>
<p>If you have any ideas for the first one (the document explaining
what we do, what <a href="http://QGIS.ORG" target="_blank">QGIS.ORG</a> is and why we should be regarded as a
"non-profit") please let me know. I will provide an initial
document for the "Tätigkeitskonzept" - I don't even know what a
correct english term would be ...</p>
<p>For those who can understand german, here is a very brief summary
what we need to fulfill for tax exemption:</p>
<p>"Die Tätigkeit der juristischen Person muss ausschliesslich auf
die öffentliche Aufgabe oder auf das Wohl Dritter gerichtet sein;
Unwiderruflichkeit der Zweckbindung: Die Mittel der juristischen
Person sind für immer dem steuerbefreiten Zweck verhaftet. In den
Statuten oder in der Stiftungsurkunde muss daher ausdrücklich
festgehalten werden, dass die vorhandenen Mittel dauerhaft dem
festgelegten Zweck gewidmet sind. Für den Fall der Liquidation ist
eine Formulierung vorzusehen, die wie folgt lautet: "Im Falle
einer Auflösung werden Gewinn und Kapital einer anderen wegen
Gemeinnützigkeit oder der Verfolgung öffentlicher Zwecke
steuerbefreiten juristischen Person mit Sitz in der Schweiz
zugewendet"</p>
<p>Weiters: "Der Begriff der Gemeinnützigkeit ist im Steuerrecht
enger gefasst als im allgemeinen Sprachgebrauch. Er ist
hauptsächlich durch folgende Merkmale gekennzeichnet:
Allgemeininteresse: Die Tätigkeit der juristischen Person muss im
Interesse der Allgemeinheit liegen und gilt aus gesellschaftlicher
Gesamtsicht als fördernswert. Ein Allgemeininteresse liegt
regelmässig nur dann vor, wenn der Kreis der Personen, denen die
Förderung beziehungsweise Unterstützung zukommt, offen ist;
Uneigennützigkeit: Eine gemeinnützige Tätigkeit ist unter
Ausschluss persönlicher Interessen der juristischen Person und
ihrer Mitglieder auf das Wohl Dritter gerichtet. Die juristische
Person verfolgt keinen Erwerbs- und keinen Selbsthilfezweck. Unter
Hintansetzung der eigenen Interessen und unter Einsatz personeller
und/oder finanzieller Mittel erbringt sie Opfer zu Gunsten der
Allgemeinheit. Ein öffentlicher Zweck liegt vor, wenn eine
juristische Person ohne Erwerbs- oder Selbsthilfezweck eine
umfassende Tätigkeit zu Gunsten einer eigentlichen Aufgabe des
Gemeinwesens erfüllt und ihre finanziellen Mittel dauernd und
ausschliesslich diesem Zweck gewidmet sind. Als öffentlich gelten
alle Zwecke, deren Erfüllung in den ordentlichen Aufgabenkreis des
Gemeinwesens fallen können. "<br>

<p>Basically it means that we need to make sure that the finances we
receive are only used for the good of a public service or for
third parties and - in case that <a href="http://QGIS.ORG" target="_blank">QGIS.ORG</a> would be dissolved -
that remaining funds would be transferred to a similar non-profit
organization. Not sure if it really has to be a "Swiss
institution" - naturally, we would transfer any assets to OSGEO or
FOSSGIS in case of a dissolve of <a href="http://QGIS.ORG" target="_blank">QGIS.ORG</a>.</p>
<p>In the second paragraph the summary is, that the organization has
to be "inclusive" - the services available to anyone without
restrictions - and the primary reason of the organization is not a
pecuniary reward.<br>
</p>
<p>I will have a phone call with the person in charge to make sure
we use the right wording - provide the correct content in the
remaining documents.<br>
