True. We are not lawyers. But I was once told by a lawyer that the 
spirit of an agreement is more important than the legalese.

And in my view, if the spirit of the agreement was meant to prevent the 
original contributor from relicensing his own contributed code (and his 
own code only) then I would say that the Foundation failed in its 
mission of openness.
