So... If you are constructing a dataset (for example for potholes like otrobache.com), and that dataset is release with a Creative Commons License to grant access to to everybody, then... then you can use as much as you want Google services as they will be granted permission like anyone else.

In the case your dataset will not be freely available then you have three choices:
	1) Accept that Google can also use the data (not very specific how they can use it, but they say through the service)
	2) Pay for a license from Google
	3) Use a free service that does not impose the same as Google.

From my point of view this looks like a very reasonable policy by Google and curiously helping people to release  Open Data. Would be interesting to write about this and have Google confirm it.
