Hola Jorge,

Que yo sepa si que está permitido. La forma en que cumplen con los términos es utilizando la API de Google desde OpenLayers. Es decir, no accedes directamente a los tiles sino que utiliza internamente la API de Google.

Y hay bastantes web usándolo de esta forma.
