Thanks guys, 
it turns out you need to pass the parameter when you first add the WMS layer
to the map, not during the definition of the getfeatureinfo()

  layer = new OpenLayers.Layer.WMS( "MapGuide WMS",
                    "/mapguide/mapagent/mapagent.fcgi?SERVER=wms", {layers:
'layers/parcels', INFO_FORMAT:'text/xml'} );
