Sure I tried before 8) ! Here is an extract of my MAP file :

LAYER
	NAME "bounds"
	DATA "bounds.tif"
	TYPE RASTER
	MINSCALE 500000
	STATUS ON
END 

LAYER
	NAME "bounds100"
	DATA "bounds100.tif"
	TYPE RASTER
	MAXSCALE 500000
	STATUS ON
END 

the 1st layer called "bounds" is always displayed, and the 2nd one never !
For information, I use MapServer 3.6.3 throw its WMS connector. Here is a 
typical URL I send :
