I think this one is causing your problem:

> POSTLABELCACHE TRUE

According to the docs MapServer is acting correctly: "Tells MapServer to render 
this layer after all labels in the cache have been drawn."

Your point layer contains labels. So your polygon layer will always be drawn 
afterwards.
