Do a WFS GetCapabilities ( service=WFS&request=GetCapabilities)
and see whether your service does support DWITHIN. Not all do - 
especially ArcGIS 9.3. I dont know if it was added in 10.0 or not. 
Geoserver does. Dont know about others.
