 I think that the bug this ticket is about is fixed in OL 2.12-rc3.

 With respect to my previous comment I'm having another bug (tiles not
 loading after page load). I had to apply fix from my previous comment.

 I'm however unable to reproduce this bug in some simplified test case. I
 think this ticket can be closed.
