Ok I messed up loading the shp data.  The meta data said it was 
projected in NAD83 Washington State South METERS.  I have reloaded the 
data using SRID 2856.

And now this works:
within(Transform(SetSRID(MakePoint(-122.916725, 
47.046528),4269),2856),the_geom)
