Matt,

I see your point.  Couldn't it be handled the same way other third party
drivers are handled?  Like ArcSDE or MrSID.  Or is that different?

The GPC licensing might make that tricky:

 "You may not use this software, in whole or in part, in support of
any commercial product without the express consent of the author."

This would conflict with GDAL/OGR's license quite a bit.
