Queries can apply to one or more layers, so it's a map level deal. Layers wouldn't be processed to the msLayerWhichShapes() point unless a query or drawing operation applied to that layer.

Regarding one-pass, would the contents of the queryObj suffice? It fully encapsulates the query (if it is indeed a query being done) and would be accessible through the layer’s pointer back to the parent mapObj (layer->map->query).

I thought it was rather a layer level parameter than map level. It could however be good as far as it is set before each whichShapes call (not only with the feature queries but in a normal drawing as well), and should also be exposed to the mapscript API.
