query by point - selecting nearest feature from top layer

Hi All
 
I'm using mapserver 4.6 with phpmapscript (php 5.0.5) on windows IIS 5.0
 
what I'm confused about is that when I do query by point by clicking on map mapserver does this query but selects the nearest (from the specified point) feature from the top visible layer. So when I do point query on roads which are displayed under other point layer as a result I allways get the nearest point, not the road that I have clicked on on my map.
What can be the cause of this. Can You please help me??!!
 
i've set the toleranceunits and tolerance for each of my layers in my mapfile, the buffer value in php code is set to -1 (if i set it to 0 the result is the same)
when I do query on top layer, the results are precise, correct feature is beeing selected
