It forbids distribution of the EPSG Facilities for profit, not the data.
These are different things as defined in the license.

Forbidding distribution for profit is non-free too. It breaks the first
item in the OSD & DFSG:

"
 1. Free Redistribution

 The license shall not restrict any party from selling or giving away
 the software as a component of an aggregate software distribution
 containing programs from several different sources. The license shall
 not require a royalty or other fee for such sale.

If modification is not explicitly allowed in the license terms, it's
forbidden by copyright.

This also why the FastAC code in LASzip makes it incompatibly with the
LGPL which explicitly allows modification, see:
