[Qgis-user] Layer filter not working correctly?

I am workning on an OSM road network stored as a shape file and I want to
exclude the features having highway='footway'.

I am using filter in the legend panel:

Using "highway"<>'footway' excludes footways as expected.
But "highway"  NOT IN  ('footway') still includes the footways?

I have only used point and click creating the filters, so there are no
typos.

I have attached a section of the file for others to test:  OSM.zip

Anybody else have experienced this kind of problems (I have seen problems
with the IN or NOT IN earlier)
