That is the new default behavior regardless of what the IGNORESCALE
setting is. If you don't want the selection you could always remove it
via the API or the user could simply click on an open space in the map.

Before voting on this, can I confirm that the following section only
applies if the IGNORESCALE=1 flag is set, and that this value will be
passed down from the inital weblayout call to the mapviewer so that the
behaviour can easily be changed on a per-layout basis?
 
"AJAX Viewer behavior will change slightly with this RFC. If the user
selects one or more features on a layer, and then zooms out to a scale
where that layer is not visible, the selected features will still be
visible (even though other features on that layer are not). This is
desirable because you can zoom out and then generate a large scale
buffer around the selected feature(s) and immediately see the result. "
