legend not drawn with mapserver 5.0?

yes its a bug that will be fixed in 5.0.1.
for the time being you can replace maplegend.c in your source tree by this one:
http://trac.osgeo.org/mapserver/browser/branches/branch-5-0/mapserver/maplegend.c?format=raw
and recompile.
